October 29, 2020: Zoning Board of Appeals

Chairman Richard Lenart called the public hearing to order at 6:00PM followed by the Pledge.

Present:  Dick Lenart, Tom Wadas, Kevin Kutas, Jackie Wolanin and Kate Hartnett

A motion was made by Kevin Kutas, seconded by Tom Wadas to approve the minutes of the October 22, 2020 meeting.  All in favor, motion granted.

A motion was made by Kevin Kutas, seconded by Tom Wadas to open the Public Hearing.  All in favor, motion passed.

Clerk sent 30 letters out to the residences within the 500-foot radius.  The applicant also submitted letters from residents as well as photographs. 

ZBA Public Hearing for Richard Broccoli at 408 Main Street regarding a request for a variance to use the property as a sales office.

Dick explained the reason for the public hearing.  RJ Broccoli was in attendance and advised the Board that the property would be used by him and two employees.  It would be a sales office and would not have any incoming costumer traffic.  Their business is selling wholesale foods.  The property reverted back to R2 after Dr. Wadas moved out.  They would not be doing any constructional changes at this time.  

Residents were in attendance: 

Geri Barnes – 412 Main Street spoke with regards to potential noise.  She feels that they have pick up trucks and dogs, and that it will create more noise around her property.

Robert Sharpe – 402 Main Street stated that he is against this because he feels that the property should remain residential.  He is not in favor of allowing businesses in a residential area.

John Semeniak – 418 Main Street

Evan Hanna – Chestnut Street spoke in favor of the variance.  He stated that before when Dr. Wadas was there that cars were parked on the street on Chestnut in front of his house.  He thinks this would be a much better situation for the neighborhood.

Carl Dziekan – attorney for Ted Wadas spoke in favor of the variance.  He feels that there is no better owner of this home then the potential buyers, claiming that this would cause minimum disturbance.

A motion was made by Kevin Kutas, seconded by Tom Wadas to close the Public Hearing. All in favor, closed at 6:52PM. 

Discussion between Board Members included but not limited to the following:

                No extra traffic

                No warehouse

                No customer Traffic

                Professional Office

                Parking in Driveway and not on roadway

                Property going back to residential if it is sold again

               

A motion was made by Kevin Kutas to grant the variance request, seconded by Tom Wadas.  All in favor, variance granted.

A motion was made by Kevin Kutas, seconded by Tom Wadas to adjourn the meeting.  All in favor, meeting was adjourned at 6:56PM.
