Mayor Maciol called the meeting to order at 7 PM followed by the pledge to the flag and roll call.

Received the following sealed bids:

Trustee Semeniak made a motion seconded by Trustee Jarosz to accept the high bid of $1,352.00 from John Moorehead.
Ray Collins – Clinton Street, still has a water problem at the end of his driveway, Al will look into a 45-degree curb.
Trustee Semeniak made a motion seconded by Trustee White to accept Abstract #5, General vouchers A255-A308 in the amount of $47,147.26 and Library vouchers L045-L053 in the amount of $3,237.88 for a total of $ 50,385.14.
Trustee White made a motion seconded by Trustee Semeniak to accept the September Treasurer’s report. Check numbers for September are: payroll 5473-5542, general 10200-10276.
Trustee White made a motion seconded by Trustee Semeniak to accept the minutes of the September 12th board meeting as presented.
Trustee Semeniak made a motion seconded by Trustee white to accept the minutes of the September 27th workshop as presented.
Recreation – Holiday on Main Street will be Sunday December 10th 5 pm to 8 pm, everything is going good.
Police – Chief Frankland gave his report, which is on file in the Clerk’s office. Mayor received a phone call from Joe Urbas thanking the Chief for his help in a situation he had. Trustee White made a motion seconded by Trustee Bialek to accept the Chiefs report.
Highway – Trustee Jarosz gave Highway report in Joe’s absence; report is on file in the Clerk’s office. The 97-plow truck does not have reverse; Mayor will contact Don Heintz, no longer under warranty. The 93 Chevy has engine problems, Joe will get an estimate. The loader is still not working properly, the light still comes on and it losses power. Trustee Semeniak made a motion seconded by Trustee Bialek to accept the Highway report as presented.
Fire Department - Trustee Bialek stated that the Fire Department did an outstanding job with the fire at 319-321 Main Street. Trustee Bialek has requested the amount of $110,179.78 for the Town of New Hartford Fire Contract. They are still meeting on the Town of Whitestown amounts but have requested $.88 per thousand, which would be approximately $114,138.38. The Fire Department has approved a Recruitment and Retention Plan at their last meeting and will be presenting it to the village board.
Code Enforcement – no report
Engineer – Al reported that the 2006 Sewer and Road Repairs work for Clinton St, Maple St, Garden St, and Burr Ave is completed. The pavement top course is pending along with the Burrstone Road sanitary repair. The 2006 Paving of Country Club Dr is complete and Burrstone Road has been milled and is waiting for curbing and asphalt overlay. The Sauquoit Creek Basin Intermunicipal Commission Pietryka Park bank stabilization project is in progress.
Attorney – The Comenale/Glod trial is upcoming, will keep us posted. Deed for the #2 Mill should be complete.
NYMFDLA Request – Trustee Jarosz made a motion seconded by Trustee White to allow the Ladies Auxiliary to use the firehouse for their annual pizza sale Thursday Oct 19, Friday Oct 20 and Sat Oct 21.
Fountain Head Project – Dave Kleps presented the expansion plans proposing an 80,000 square foot expansion along with a land swap between Fountainhead and Roselawn. With this land swap a zoning classification change is also requested from PD to M-1. Trustee White made a motion seconded by Trustee Jarosz to appoint the New York Mills Village Board as lead agency for the proposed zoning change and to schedule a public hearing for SEQR review November 14th at 7 PM.
Delinquent Taxes to County – Trustee White made a motion seconded by Trustee Semeniak to allow the Clerk to send the following delinquent taxes to the county:
Town of New Hartford $ 14,083.84
Town of Whitestown 1 $ 15,738.20
Totaling $ 29,822.04
Fire Horn Grant –Senator Ray Meier has secured a grant in the amount of $17,000 from the 2006/2007 state budget for the purchase of a new fire horn.
NYCOM Meeting – 2007 Legislative Priorities Monday November 13th at the Crown Plaza in Albany.
New Hartford ZBA Meeting – there will be a public hearing on October 16th at the Community Center Building on Kellogg Road at 7 pm regarding Benderson Development for a restaurant in the strip mall and parking.
Park Trail Grant Application – Trustee Jarosz made a motion seconded by Trustee Bialek to allow the Mayor to apply for a trail system grant that is due on October 13th.
Sauquoit Creek Project – the creek has been restored to almost its original state. The permanent road to the island will remain along with the 200 feet of crusher run road.
West Drive Issue – we need to make a decision about changing it from a one-way to a two-way street. We sent 33 letters to residents last year, 10 responded in favor of 2-way, 1 responded against. We need to look into the parking matter.
NYRI Update – Governor signed legislation regarding the eminent domain.
Mill Project – they are cruising along, they poured concrete all last night, the metal studs are up and it should be closed- in within the next two weeks.
Council of Villages – next meeting will be here October 18th at 6:30 pm.
EPA – received correspondence for the DPW with new enforcements and surprise inspections for Region 2. Don’t know yet how much of this will apply to us.
Trustee Baryla-White – inquiring who will be able to use the new community center. Mayor stated we will have to establish rules and regulations.
Trustee Bialek – there will be an auction November 11th in Canastota if we have anything we want to sell. We need to send a letter to Roger Cleveland for the bucket truck for Christmas decorations.
Trustee Jarosz – attended the Library board meeting in which they questioned why they need to be on the Mid-York website, they would just like to be on ours. We need to look into seeing if they pay to be on the Mid-York one.
Trustee Semeniak – would like to commend the Fire Department and Police Department for the 319-321 Main Street fire.
With no further business Trustee Semeniak made a motion seconded by Trustee white to adjourn the meeting.
Mayor Maciol adjourned the meeting at 9:30 PM.
