Mayor Maciol called the Regular Board Meeting to order at 7 PM followed by the pledge to the flag and roll call.
Present: Mayor Maciol, Trustee Baryla-White, Trustee Bialek, Trustee Jarosz, and Trustee Semeniak
Also present: Highway Supt. Joe Cotrupe
Public Hearing on Local Law #1 for 2008
Trustee Jarosz made a motion seconded by Trustee White to open the public hearing at 7:02 PM. Mayor read the legal notice.
Dr. Rosinski was not present but has expressed his concern and agreement to this change.
Trustee Semeniak - feels it is a nice compromise versus a total change.
Trustee White - feels it's a nice give and take.
Trustee Jarosz and Trustee Bialek are also in agreement with the change.
Trustee White made a motion seconded by Trustee Semeniak to close the public hearing at 7:15 pm.
Trustee White made a motion seconded by Trustee Jarosz to adopt Local Law #1 for 2008 which states: to amend section 194.10 of the Vehicle and Traffic Law - Parking Prohibited in designated locations. Amend the current "prohibited parking on Main Street 20 feet north and 40 feet south of the Twin Ponds entrance" to "prohibit parking 20 feet north and 20 feet south of the Twin Ponds entrance from November 1st to April 1st and 40 feet south of the Twin Ponds entrance from April 1st to November 1st".

Gary Markowicz - 56 Greenman Ave, went to visit the old Bonide site, new Oriskany Manufacturing site, and was very impressed with it. As he walked around he noted some concerns of his:
•Ø Sees a two story building in the backyard of a Main Street resident with five electric boxes and no fire escape, could pose a fire hazard;
•Ø Siding on the two story building need repairs;
•Ø Understands there is a business operating there, large trucks stop on Main Street and walk deliveries back to the apartment building;
•Ø Debris in bushes;
•Ø The overall building looks deplorable.
He just wanted to make the board aware of these concerns and conditions that are visible from the Oriskany Manufacturing property.
William Blank - 34 Burr Ave, concerned with 2A Burr Ave which had extensive renovations done and he no longer sees a pipe pumping water out of the cellar, he is concerned that they may have hooked into the sewer system. Mayor will look into matter.
Christine Krupa - 504 Main St, representing the Town of New Hartford, concerning a follow-up letter to Mr. Tom McCraith regarding a meeting with him on Friday January 11th at 11:30 am. Mayor reconfirmed that date and time and stated the meeting is regarding a possible future development.
Pete Moskal - Main St. still against the zoning change on the Wurz Ave property, a vote tonight would be appreciated. Village Attorney Borrill stated that Oriskany Manufacturing requested the matter of voting on the zone change be tabled to the February meeting. Our zone map may be labeled incorrectly, the 2 Wurz Ave property on the map says PD but the April 1995 minutes show local law #2 for 1995 changing the zoning to PM. Attorney will check to see if the local law was every filed with the state back then.
Discussion on Roberts Rules of Order followed. The Clerk will research the minutes from 1922 to present to see if we ever adopted the Roberts Rules of Order at any Organizational Meetings.
Pete Moskal asked if the board adopts the Roberts Rules of Order at the April Organizational Meeting will Oriskany Manufacturing be grandfathered in. Village Attorney replied under the Roberts Rules of Order they will not be grandfathered in.
Attorney also stated that if you follow the Roberts Rules of Order you must adopt them each year at the Organizational Meeting.
Three board members thought the vote was over regarding the zone change when no second was made.
Trustee Semeniak made a motion seconded by Trustee White to approve Abstract #8; General vouchers A437-A488 in the amount of $89,674.38 and Library vouchers L070-L077 in the amount of $3,320.31 for a total of $92,994.69.
Trustee Semeniak made a motion seconded by Trustee White to approve the December Treasurers report.
December check numbers: General - 11341-11402, Payroll - 6618-6687.
Trustee Semeniak made a motion seconded by Trustee White to approve the minutes of the December meeting as presented.
Recreation - received recognition in Friday's OD for giving the gifts collected from the sleigh rides to the Utica Zoo.
Police - while Chief Frankland is recovering Sgt Soja is in charge, everything is going smooth. Will continue to check truck traffic on Greenman Ave for two more weeks and compile data. Heart Run Kick-Off meeting was held today. Trustee Bialek met with Sgt. Soja regarding the computer in police department that needs work.
Highway - Joe gave his report, concerned with gas lines freezing in the cold weather - would like to use another vendor for fuel. Trustee Bialek suggested checking with the Town of New Hartford. Trustee Bialek thanked the Highway Department for taking the Christmas decorations down.
Trustee White made a motion seconded by Trustee Semeniak to accept the Highway report.
Fire Department - Trustee Bialek is following up on the fire contracts, no public hearing yet for the Town of Whitestown. Truck 1 is all set, everything checked out, Engine 1 parts are in and work will be done next week.
Trustee Jarosz made a motion seconded by Trustee Bialek to allow the New York Mills Fire Dept Ladies Aux to use the fire house Feb 29th, March 1st and March 2nd for the annual ham dinner.
Code Enforcement - Dave out of town, no report.
Engineer - Al has a scheduling conflict but gave his written report which is on file in the Clerks office. Update on the sanitary sewer rehab - National Water Main Cleaning crew has been on site since December 3rd. Al reviewed a draft agreement regarding the purchase of infiltration removal credits by the Town of New Hartford and forwarded his comments to the Mayor. Resolution # 2-2008 - Trustee Bialek made a motion seconded by Trustee Semeniak to grant the Mayor permission to sign the infiltration removal credits contract upon clearance from the Town and Attorneys when revised.
Attorney - the #3 Mill is being sold and the paperwork being completed to turn the decorative lighting bills over to the new owner. He redid the custodial janitorial contract.
Election Resolutions - Resolution 3-2008 - Trustee Bialek made a motion seconded by Trustee Semeniak to appoint the following as election inspectors for the General Village Election to be held on Tuesday March 18, 2008: Nancy Bien, Wanda Miller and Nellie Polczynski.
Resolution 4-2008 - Trustee Semeniak made a motion seconded by Trustee Jarosz that the Village Board Room, Municipal Building, 1 Maple Street, NYM will be the polling place for the General Village Election to be held on March 18, 2008 from 12 noon to 9 PM.
Council of Villages - next meeting will be Wednesday January 9th at Yorkville at 6:30 PM.
Grievance Resolution - Resolution 5-2008 - Trustee Semeniak made a motion seconded by Trustee White to hold Grievance Day Tuesday February 19th from 6pm - 9pm.
Copy Machine Lease - leases are up in April, received quotes for leasing new ones. Resolution 6-2008 - Trustee Bialek made a motion seconded by Trustee Jarosz to continue to lease from Upstate Office Equipment.
Zone Change - tabled until February.
Municipal Building Air Conditioning - Mayor is working on quotes.
•ü Retirement party for Matt Shannon is Friday January 18th.
•ü Dave Neary working on a fund raiser for Chief Frankland for February 9th.
•ü Hilltop Seniors Christmas Party January 17th at Twin Ponds at 1 PM.
•ü Garbage out early warning notices from both holidays were noted by the Police Dept, most violators were renters.
•ü NYS DOT will hold a meeting here Friday January 11th at 10AM to brief us on the spring milling and paving of Burrstone Road along with discussing the full reconstruction that is set for 2011.
•ü Wrote a letter to the DOT regarding speeding cars coming down Burrstone Road by the school, would like to see additional warnings at the top of the hill.
•ü NYM Historical Society - a possibility the possessions of the Historical Society may find a new home in the meeting room in the Library.
Trustee Baryla-White - asked Clerk to get her the 2007 recreation and youth grant amounts.
Trustee Bialek - nothing

With no further business, Trustee Semeniak made a motion seconded by Trustee Jarosz to adjourn the meeting.
Mayor Maciol adjourned the meeting at 8:35 PM.
