Mayor Maciol called the regular board meeting to order at 7:04PM followed by the pledge to the flag and roll call.
Present: Mayor Maciol, Trustee Bialek, Trustee Jarosz, Trustee McCoy and Trustee Semeniak
Also present: Highway Supt Cotrupe, Police Chief Frankland, Codes Officer Neary, and Village Engineer Swierczek
Mrs. Dorothy Kula - Main Street, is concerned with the broken sidewalks on Main Street by 501 Main Street and Glassy Business, feels it's a safety issue. Mayor stated that we can 1) make them aware of our sidewalk replacement program, 2) 501 Main Street may be included in our paving work this year, and 3) we are waiting to hear on a grant "Safe Routes to School" which will replace some sidewalks. Mayor will continue to look into.
Jackie Wolanin - New Hartford Street, is concerned with the deteriorating condition of the pillars by McCraith. Mayor stated that we are already looking into funding to have the pillars refurbished.
Trustee Semeniak made a motion seconded by Trustee Bialek to accept Abstract #2; General vouchers A048-A123 in the amount of $99,269.72 and Library vouchers L009-L026 in the amount of $5,582.85 for a total of $104,852.57.
Comments: Trustee Semeniak would like to see a log on repairs for the Police, Highway and Fire Department vehicles. Trustee Bialek stated we need to keep current on our fixed assets.
Trustee Semeniak made a motion seconded by Trustee Jarosz to approve the May Treasurers report as presented.
Trustee Semeniak made a motion seconded by Trustee Jarosz to approve the minutes of the June 10th regular board meeting.
Trustee Semeniak made a motion seconded by Trustee McCoy to approve the minutes of the June 24th special meeting.
Recreation - Trustee McCoy gave the Recreation report which is on file in the Clerk's office. Summer Parks Program is going very well. Trustee Jarosz made a motion seconded by Trustee Bialek to approve the Recreation report.
Police - Chief gave his report which is on file in the Clerk's office. Resolution 70-2008 -Trustee Semeniak made a motion seconded by Trustee Bialek to give Chief Frankland permission to upgrade his portable radios, computer photo printer, and external drive dedicated to the camera car system, all of which are included in this year's budget. Resolution 71-2008 -
Trustee Bialek made a motion seconded by Trustee Jarosz to purchase one computer for the Fire Department and one for the Police Department including the accessories for the camera unit. Resolution 72-2008 -Trustee Semeniak made a motion seconded by Trustee McCoy to purchase two tazer units which are in the budget. Chief would like to fill the part time vacancies. Trustee Bialek moved the router and internet to the Police Station July 1st. Trustee Bialek made a motion seconded by Trustee Jarosz to approve the Police report.
Highway - Joe gave his report which is on file in the Clerk's office. He purchased a pole saw and weed eater. The Highway started today to increase the parking lot at Pietryka Park with the help of the Town of New Hartford. Trustee McCoy inquired on how often we replace the sand and filling at the park equipment, weeds are starting to grow by some of the equipment. Trustee McCoy made a motion seconded by Trustee Semeniak to approve the Highway report.
Fire Department - Trustee Bialek stated we need to upgrade the computer in the Fire Department, permission given in the police report.
Code Enforcement - Dave gave his report which is on file in the Clerk's office. Dave would like to re-write the outdoor fire place laws for next month. Dave would like a portable radio if there is any surplus around. Chief will look. Trustee Jarosz made a motion seconded by Trustee Bialek to approve the Codes report.
Engineer - Al reported National Water Main hasn't been back to finish the sanitary sewer rehab work yet, they are waiting for National Grid's structural repair of a sanitary sewer where grounding rod was driven through the top of the village sewer. Al received a call from Oneida County Planning; they currently have crew GPS-locating manholes on our sanitary system. Rayhill Grant - award by state 80% funding, DOT may go with the project.
Attorney - Bill asked to go into executive session to discuss law suit by local residents regarding Oriskany Manufacturing. He has received a purchase offer from the Sitrin Home.
Energy Performance Contracting Services - Chris Kalwara gave a presentation on energy performance with means of procuring, construction, financing infrastructure improvements for the village. Resolution 73-2008 -Trustee Semeniak made a motion seconded by Trustee Jarosz authorizing the Mayor to sign an agreement to do the preliminary study.
ZBA & Planning Board Alternates - Resolution 74-2008 -Trustee Jarosz made a motion seconded by Trustee Bialek to appoint Fred Griffiths as the ZBA alternate. Resolution 75-2008 -Trustee Semeniak made a motion seconded by Trustee McCoy to appoint Joe Cattoradoris Jr. as the Planning Board alternate.
Paving Bids -we received the following bids:
Resolution 76-2008 - Trustee Jarosz made a motion seconded by Trustee Bialek to award the paving bid to Ocuto Blacktop & Paving Co Inc. at the bid price of $67,472.00 with an additional 125 feet of paving to be added at the approximate cost of $9,200.00 for a total of $76,672.00.
Soil & Water Agreements - Al feels it would be duplicate services between him and them. Resolution 77-2008 - Trustee Semeniak made a motion seconded by Trustee Jarosz not to partake in the agreement per our Village Engineer services.
Sitrin Offer - Resolution 78-2008 - Trustee Semeniak made a motion seconded by Trustee Bialek to have Frank Donato do a vacant land appraisal on the village property that the Sitrin Home is interested in purchasing.
Court Grant - Resolution 79-2008 - Trustee Jarosz made a motion seconded by Trustee Semeniak for the following resolution to grant permission to our court to apply for the 2008 Justice Court Assistance Program (JCAP).
Council of Villages - will be Wednesday July 9th at Oriskany.
Assistant Clerk Position - we will advertise for the Assistant Clerk Position with applications to be back by 3pm on August 8th.
Police Consolidation Study - nothing new to report
Bell - Firehouse - found out that there are steel beams behind the bricks on the pillars, the bell doesn't have to be removed just need to replace the brick work.
Mohawk Valley Smoke Free has supplied us with signs for our parks along with $1,000 worth of park benches and tables to be paid by this grant.
NYCOM is holding a workshop in Rome July 29th at 2pm on the 207 and 207C if anyone can attend.
July 15th at 4 pm is the ribbon cutting for the Rayhill trail.
Trustee Bialek - looking for a locking file cabinet for the Library vouchers. Would like a phone call when special meetings are called.

Trustee Jarosz made a motion seconded by Trustee Bialek to adjourn the meeting and enter into executive session at 9:26 PM to discuss pending litigation.
On a motion by Trustee Semeniak and a second by Trustee McCoy, executive session was closed and the regular meeting was re-opened at 9:51 pm.
Resolution 80-2008 - On a motion by Trustee Semeniak and a second by Trustee McCoy, the Village Attorney, William Borrill is authorized to interpose a defense to the lawsuit brought forth by Christine Krupa, Mark Krupa, Amy Topor, Mathew Gamela, JoAnne Moskal, and Peter Moskal in its entirely.

Regarding the building air conditioning, the Village Board agreed to give Country Suburban an opportunity to repair our air condition system, if it is not fixed by Wednesday the 16th, a portable unit will be purchased for the police station.
On a motion by Trustee Semeniak and a second by Trustee Jarosz the regular meeting was adjourned at 10:06 pm.
